My dear Governor:
I am writing to advise you that the Treasury Department will expect the Federal Reserve Bank of New York if at any time it becomes involved, or expects to become involved, in litigation in its capacity as fiscal agent of the United States, to report the facts immediately to the Department and request instructions as to the course to be pursued. I presume that you have already had this in mind, but I am calling it to your particular attention because the Department wishes to be certain that it is kept fully informed with respect to all such litigation from its inception, in order that all necessary steps may be taken to protect the rights of the United States and that no action may be taken by inadvertence or otherwise which might prejudice its interests.
